Rental Terms and Conditions

These are the terms and conditions subject to which we (Flextron) allow you (the hirer) to hire our equipment (including all items that we offer for hire). By signing or purchasing the rental hire equipment in this agreement, paying us any fees or taking possession of our equipment you agree to be bound and it will be deemed consent to these terms and conditions.

1.    We own the equipment and hire it to you for the hire period. You may not deal with the equipment in any way which is contrary to our ownership of it.

2.    Equipment may not be sub hired without our consent.

3.    Equipment must only be used for its normal function as determined by us.

4.     Hire contracts are 7 days, 14 days, 3 or 6 months or flexible and the hirer agrees for this to be paid via the website checkout.

4.    Risk in the equipment passes immediately to you when the equipment leaves our possession and you are responsible for care of all items. You remain responsible until the equipment is safely returned to our possession.

• 4.1. Leaving our possession is defined as when you or a representative physically come in contact with equipment.
• 4.2. Returned possession is when we acknowledge that all equipment is returned to our possession

5.    All damage to or loss of equipment during the hire period will be the financial responsibility of the hirer, regardless of party at fault. In this case a £449 damage penalty will be charged to the hirer.

6.    At no time is the equipment to be repaired by the hirer without our written permission.

7.  It is the responsibility of the hirer to confirm the condition of all equipment is undamaged prior to the hire period and that all equipment is present at the time of pick up or delivery. And must be reported within 24 hours of receiving. 

• 7.1. If there is a defect, incorrect or missing equipment we must be notified within a reasonable time.  Any notification must include specific details of the issue.

8.  If equipment fails during the hire period, we are to be notified immediately and we will endeavour to repair or replace the equipment. If the equipment failure is not proven to be a manufacturing fault, clause 5 will apply.

9.  A

• 9.1. If we deem any damage to our equipment has occurred during your hire period, you authorise us to charge the damages penalty to restore equipment as detailed in clause 5.

10.  If equipment is not returned within 7 days after the hire period has concluded, a weekly fee of £50 will be charged for every week until the equipment has been returned in full.

11.  The hire or service detailed in the quotation may be canceled by the hirer at any time in writing.

• A minimum of 7 days notice must be given and a minimum of 7 days will be charged to the hirer at the rate of the specific hire term.

12. Flextron use an External company to complete the Direct Debit payments. All fees due to dishonoured payments will be subject to be paid by the hirer.

13.  Electronic communication in the form of email via flextron website's contact form is an accepted form of written communication for this agreement.

14.  We are not liable for any injury, death or other damage that arises from the use of our equipment or the actions of the hirer.

15. The hirer is responsible to consult with their local doctor regarding suitability to use the compression boots and agrees they have none of the following medical conditions that would be a contraindication to use:

• Acute pulmonary edema
• Acute infections
• Acute thrombophlebitis
• Arrhythmia
• Blood Clots
• Bone fractures or dislocation at or in the vicinity of treatment application.
• DVT (Deep Vein Thrombosis)
• Episodes of pulmonary embolism
• Erysipelas
• Hypertension
• Osteoporosis
• Open wounds or inflammation at the site of application.
• Patients with pacemakers
• Taking medication for any cardiovascular or musculoskeletal illness
• Where increased venous and lymphatic return or blood flow is undesirable due to a specific medical condition

16.  If any term in this agreement is found to be legally void, invalid or unenforceable this does not void the remaining terms of the agreement.

17.  Failure to comply with this agreement by Flextron that is out of our reasonable control will not render us liable for loss to the hirer or third party.

By continuing with the rental I, for myself or the Hirer who has authorised me, confirm that I have read the hire agreement and consent to the terms set out by Accelerate Recovery.

Contraindications

Do not use this product if you are experiencing unknown pain, have an undiagnosed medical condition, an infection or an open would or bleeding.

Do not use this product if you have any of the following medical conditions:

• Acute pulmonary edema
• Acute infections
• Acute thrombophlebitis
• Arrhythmia
• Blood Clots
• Bone fractures or dislocation at or in the vicinity of treatment application.
• DVT (Deep Vein Thrombosis)
• Episodes of pulmonary embolism
• Erysipelas
• Osteoporosis
• Open wounds or inflammation at the site of application.
• Patients with pacemakers
• Unstable hypertension
• Where increased venous and lymphatic return or blood flow is undesirable due to a specific medical condition
